TERMS OF USE

Section 011. About Eimdal and These Terms

Eimdal is a gaming and esports platform operated by Forgeblast SAS.

Eimdal provides features that may include:

• local gaming communities
• squads
• rankings
• quests and challenges
• competitions and events
• connected game accounts
• virtual reward systems
• local and digital rewards
• paid subscriptions
• in-app purchases
• community features
• other gaming-related services

Certain features may have additional rules, eligibility requirements, promotional terms, or partner conditions.

Where additional terms apply to a particular promotion, competition, reward, or feature, those additional terms form part of your agreement with us for that activity.

Section 022. Acceptance of These Terms

By using Eimdal, you agree to comply with these Terms and applicable laws.

If you use Eimdal on behalf of an organisation, school, university, employer, club, or other entity, you represent that you have authority to do so where required.

You may not use Eimdal if applicable law prevents you from entering into these Terms.

Section 033. Eligibility and Younger Users

Eimdal is intended for users aged 13 and over.

You must not create an Eimdal account if you are under 13.

If you are under the age of legal majority where you live, you should review these Terms with a parent or legal guardian.

Certain purchases, competitions, rewards, community features, or data-processing activities may require parental or guardian involvement where required by applicable law.

Eimdal may apply additional safeguards or restrictions to younger users.

Section 044. Your Eimdal Account

Certain Eimdal features require an account.

You agree to:

• provide accurate account information
• keep your information reasonably up to date
• protect your login credentials
• not share your account in a way that creates security, fraud, or eligibility risks
• notify us if you believe your account has been compromised

You are responsible for activity carried out through your account unless applicable law provides otherwise.

You may not:

• create accounts using false identities
• impersonate another person
• create accounts to evade restrictions or suspensions
• sell or transfer accounts without Eimdal's permission
• use another person's account without authorisation

Section 055. Connected Games and Third-Party Accounts

Eimdal may allow you to connect accounts from supported games, publishers, platforms, or other third-party services.

By connecting an account, you authorise Eimdal to access and process the information made available through the relevant integration for purposes such as:

• verifying gameplay
• tracking quests
• calculating rankings
• validating achievements
• providing rewards
• displaying game-related information
• providing Eimdal functionality

You are responsible for ensuring that you have permission to connect the relevant account.

Third-party services are governed by their own terms and policies.

Eimdal does not control third-party publishers, game platforms, or their availability.

A game integration may be modified, suspended, or removed if the relevant provider changes or withdraws access.

Section 066. Acceptable Use

You must use Eimdal lawfully and fairly.

You must not:

• cheat or manipulate game results
• exploit bugs, vulnerabilities, or technical errors
• falsify quest or gameplay completion
• manipulate rankings
• create multiple accounts to obtain improper rewards
• abuse referral, promotional, or reward systems
• attempt to obtain GRAPES, Gems, rewards, or benefits fraudulently
• interfere with other users
• harass, threaten, abuse, or impersonate others
• distribute malicious software
• attempt unauthorised access to Eimdal or another user's account
• scrape, reverse engineer, or interfere with the service except where applicable law expressly permits it
• misuse Eimdal for unlawful activity
• circumvent restrictions or security measures
• use automated systems, bots, scripts, or similar tools to manipulate features unless explicitly authorised by Eimdal

We may investigate suspected abuse, cheating, fraud, or manipulation.

Section 077. Quests, Rankings, Squads and Competitions

Eimdal may provide quests, leaderboards, squads, tournaments, competitions, challenges, or community activities.

Results may depend on information received from third-party game providers, Eimdal systems, eligibility rules, and other data sources.

We may correct obvious errors, duplicated results, fraudulent activity, technical issues, or incorrectly attributed activity.

Specific competitions, tournaments, or promotions may have separate rules.

Where separate rules apply, you must comply with those rules in addition to these Terms.

Eimdal does not guarantee that every competition, quest, ranking, or feature will remain available indefinitely.

Section 088. GRAPES

GRAPES are an Eimdal reward unit that may be earned through eligible activity.

GRAPES:

• cannot currently be purchased directly
• are not legal tender
• are not electronic money
• are not a bank deposit
• have no cash value
• cannot be redeemed for cash
• cannot be withdrawn as money

GRAPES may be used for eligible rewards made available through Eimdal.

Reward availability and the number of GRAPES required may change over time.

We may adjust GRAPES where reasonably necessary to:

• correct errors
• reverse fraudulent activity
• address abuse
• fix duplicate grants
• correct technical issues
• enforce reward or promotional rules

GRAPES do not create ownership rights in Eimdal or Forgeblast SAS.

Section 099. Gems and In-App Purchases

Gems are an Eimdal virtual unit that may be purchased through the app.

Gems:

• are not money
• are not legal tender
• are not electronic money
• have no cash redemption value
• cannot be withdrawn for cash

Gems may be used for eligible Eimdal rewards or features made available from time to time.

Purchased Gems may be removed, reversed, or adjusted where reasonably necessary because of:

• fraud
• abuse
• chargebacks
• cancelled or reversed payments
• duplicate transactions
• technical errors
• accounting errors
• mistaken grants

Prices, packages, and availability may change.

Purchases are subject to the terms of the applicable payment provider.

Section 1010. Rewards and Offers

Eimdal may allow eligible users to exchange GRAPES, Gems, or other qualifying benefits for rewards.

Rewards may include:

• digital game keys
• gift cards
• local-business offers
• digital merchandise
• promotional products
• discounts
• other digital or physical benefits

Rewards:

• may be limited in quantity
• may vary by country, city, age, account, or promotion
• may expire
• may be subject to stock availability
• may have partner-specific conditions
• may be withdrawn or substituted where reasonably necessary

Certain rewards are supplied by third parties.

Their own terms may apply.

Unless explicitly stated otherwise and legally permitted, Eimdal rewards, GRAPES, and Gems cannot be exchanged for cash.

Section 1111. Blast Pass

Eimdal offers a paid subscription known as Blast Pass.

Blast Pass may be available as:

• a monthly subscription
• an annual subscription

Current subscription benefits and features are displayed within Eimdal at the time of purchase.

Because Eimdal evolves, Blast Pass benefits may change over time.

Where a material change affects a paid subscription, we will apply any notice or consumer protections required by applicable law.

Monthly and annual Blast Pass subscriptions automatically renew unless cancelled before the next renewal in accordance with the applicable payment provider's rules.

Section 1212. Lifetime Blast Pass Offers

Eimdal may occasionally offer a limited number of Lifetime Blast Pass purchases during specific promotional periods.

Availability, quantity, price, and eligibility may vary between campaigns.

A Lifetime Blast Pass means access to the applicable Blast Pass subscription service for as long as Eimdal continues to operate Blast Pass or a substantially equivalent subscription service, subject to:

• these Terms
• applicable law
• account standing
• Eimdal continuing to operate the relevant service

A Lifetime Blast Pass does not:

• guarantee that Eimdal will operate forever
• guarantee that every existing feature will remain unchanged
• automatically include every future paid product, service, subscription, or offering created by Eimdal

Campaign-specific terms may also apply.

Section 1313. Payments, Billing, Cancellation and Refunds

Purchases may be processed through payment providers such as:

• Apple
• Google
• Stripe
• other payment providers used by Eimdal

The payment provider's terms may apply to billing, renewal, cancellation, payment methods, and refunds.

Automatic renewal

Monthly and annual Blast Pass subscriptions automatically renew unless cancelled before the applicable renewal date.

Cancellation

You may cancel a recurring subscription at any time through the relevant payment platform or account settings where available.

Unless otherwise required by applicable law, cancellation generally stops future renewals and you retain access until the end of the current paid billing period.

Price changes

Eimdal may change subscription prices.

Where required, we will provide reasonable advance notice before a new price applies to a future renewal.

Refunds

Refund eligibility may depend on:

• applicable law
• the payment platform used
• the reason for the refund
• the relevant purchase terms

Apple, Google, Stripe, or another payment provider may process refund requests for transactions handled through their systems.

Nothing in these Terms limits any mandatory refund, withdrawal, cancellation, or other consumer right that cannot lawfully be excluded.

Section 1414. User Content

You may be able to submit, upload, post, display, or otherwise provide content through Eimdal.

You retain ownership of content that you own.

By submitting user content, you grant Forgeblast SAS a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, transmit, and otherwise use that content only as reasonably necessary to:

• operate Eimdal
• provide the relevant feature
• display the content to intended users
• moderate or protect the service
• improve Eimdal where appropriate

This licence ends when the content is deleted from our systems, except where retention is technically necessary, legally required, or needed for legitimate dispute, safety, or compliance purposes.

You must have the rights necessary to submit content to Eimdal.

You must not submit content that is unlawful or infringes another person's rights.

Section 1515. Intellectual Property

Eimdal, its software, branding, logos, interface, designs, graphics, text, original content, and related intellectual property are owned by or licensed to Forgeblast SAS.

These Terms do not transfer ownership of Eimdal intellectual property to you.

Subject to these Terms, Forgeblast grants you a limited, personal, non-exclusive, non-transferable, revocable right to use Eimdal for its intended purposes.

Third-party trademarks, games, logos, and intellectual property remain the property of their respective owners.

Section 1616. Third-Party Services

Eimdal may interact with or link to third-party services such as:

• game publishers
• gaming platforms
• Discord
• Apple
• Google
• Stripe
• reward providers
• local businesses
• gift-card providers
• external websites

Those services may have their own terms and privacy policies.

Forgeblast SAS is not responsible for the independent operation of third-party services.

The availability of third-party services may change without Eimdal's control.

Section 1717. Location-Based Features

Eimdal may use approximate city or general-area location information to provide local functionality such as:

• nearby offers
• local communities
• competitions
• activities
• other location-relevant features

Eimdal does not intend to display your precise real-time location to other users through these features.

Certain functionality may be unavailable if location access or location-related information is disabled.

Section 1818. Privacy

Your use of Eimdal is also governed by our Privacy Policy.

The Privacy Policy explains how Forgeblast SAS collects, uses, stores, shares, and protects personal information.

Section 1919. Service Availability and Changes

Eimdal is continuously evolving.

We may:

• add features
• remove features
• modify features
• change supported games
• change reward availability
• change integrations
• perform maintenance
• suspend parts of the service where reasonably necessary

We do not guarantee uninterrupted or error-free access.

Where changes materially affect a paid service, we will respect applicable consumer rights and notice obligations.

Section 2020. Suspension and Termination

You may stop using Eimdal at any time.

You may also request account deletion through the functionality provided within the Eimdal app.

We may restrict, suspend, or terminate access where reasonably necessary, including where:

• you materially breach these Terms
• we reasonably suspect fraud or abuse
• you manipulate rewards, Gems, GRAPES, rankings, or competitions
• your activity threatens other users or Eimdal
• required by law
• necessary to protect the security or integrity of the service

Where appropriate and legally required, we may provide notice or an opportunity to resolve the issue.

Serious fraud, security threats, abuse, or unlawful conduct may require immediate action.

Termination does not remove rights or obligations that by their nature should survive termination.

Section 2121. Disclaimers

Eimdal is provided on an “as available” basis to the extent permitted by law.

We do not guarantee:

• uninterrupted availability
• that every feature will always remain available
• that third-party integrations will remain available
• that rewards will always remain in stock
• that every error will immediately be corrected

Nothing in these Terms excludes warranties, guarantees, or rights that cannot lawfully be excluded.

Section 2222. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

This includes liability that cannot legally be excluded for matters such as fraud, fraudulent misrepresentation, or other mandatory consumer protections.

To the extent permitted by applicable law, Forgeblast SAS will not be responsible for indirect or consequential losses that were not reasonably foreseeable when you agreed to these Terms.

If you are a consumer, your statutory rights remain unaffected.

Section 2323. Consumer Rights

If you use Eimdal as a consumer, you may have mandatory rights under the laws of the country where you live.

Nothing in these Terms removes or limits rights that cannot legally be waived.

This may include rights concerning:

• digital content
• digital services
• subscriptions
• recurring payments
• cancellation
• refunds
• withdrawal
• unfair contract terms
• consumer guarantees

Where mandatory consumer law conflicts with these Terms, the mandatory law applies.

Section 2424. Governing Law and Disputes

These Terms are governed by the laws of France, subject to mandatory consumer protections that apply in the country where you normally live.

If you are a consumer in the European Union, United Kingdom, United States, or another jurisdiction with mandatory consumer protections, nothing in this section removes rights you have under those laws.

Before starting formal proceedings, we encourage you to contact us so we can try to resolve the issue.

Nothing in these Terms prevents either party from using a court, regulator, consumer body, or dispute-resolution mechanism where legally available.

Section 2525. Changes to These Terms

We may update these Terms as Eimdal evolves, our services change, or legal requirements change.

The latest version will be published on this page with an updated Last updated date.

For material changes, we may provide additional notice through:

• the Eimdal app
• the Eimdal website
• email
• another appropriate method

Where required by law, we will request consent or provide notice before material changes take effect.

Continuing to use Eimdal after a change will only constitute acceptance to the extent permitted by applicable law.
